The teen from Hobbs, New Mexico has made another appearance in court after being seen on surveillance footage leaving her newborn baby in a dumpster.

Eighteen-year-old Alexis Nicole Avila appeared in court on Monday, February 28th, 2022 for a preliminary hearing to decide whether or not her case had enough evidence against her to go to a jury trial. KAMC News reports that the case would be going forward, but with a small legal change.

The judge has changed the order that the charges would be listed, having the child abuse charge to be listed first instead of attempted murder, since it's a first-degree felony.

A group of dumpster divers were the ones who found the baby on Friday, January 7th. After authorities were alerted, police found surveillance footage depicting Avila throwing a trash bag with the baby inside into a dumpster, getting back into her car and leaving. She told police she was unaware that she was pregnant until the day before and that she "panicked."

Throughout the hearing, multiple people testified, including the baby's father. He said that Avila told him she had a miscarriage at some point before the incident happened. The defense claimed that Avila never said exactly that she was pregnant or that she had a miscarriage.

The baby has been in the custody of the father since the incident.
