You Can Take Pervy Photos In Texas Now Because of the First Amendment
On Wednesday, the highest criminal court in Texas threw out a state law banning "improper photography" in public, because they believe it violates "free-speech rights." This means everyone has the right to take pictures of you and your children without an consent.
This ruling stemmed from a case involving a man who was criminally charged after taking photos of children in swimsuits at Seaworld, without parental consent.
According to Bexar county assistant district attorney, Cliff Herberg, Wednesday's ruling benefits the bad guys since, "Typically the people that are getting caught up in this law are people that are in the process of moving through stages of becoming a pedophile."
Herberg also stated that the law usually helps police when they see individuals taking improper photos, by giving officers the opportunity to search the person's phone, or to issue a warrant to search a person's home, which usually leads to even more improper photos.
The ruling does still make it illegal to take photos of anyone in a bathroom or private dressing room.
