According to CBS News 9 in Tulsa, the trooper was trying to help two men by getting them out of harm's way. But the two men didn't want to leave their vehicle, leading to an altercation.

According to the report, the Oklahoma Highway Patrol got a call Friday night around 9:20 saying there was a motorist who needed help.

When the troopers arrived, they found two men pushing a truck out of the flood waters.

One of the troopers told them to get to safety as the water was rising very fast. The report says as the men exited the water, there was a confrontation and one of the troopers was assaulted.

As he defended himself, he fired his weapon and fatally shot one of the men.

The dead man is 35-year-old Nehemiah Blessed Fischer. His 42-year-old counterpart Brandon Anthony Fischer was taken to the Okmulgee County Jail on charges not yet known.
